1. Acceptance of Terms
By accessing or using Midwest Turf & Repair's services, website, or facilities, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use our services. These terms apply to all visitors, customers, and users of our services.
2. Services Provided
Midwest Turf & Repair provides small engine repair and maintenance services for various types of outdoor power equipment, including but not limited to:
- Lawn Mowers: Push mowers, riding mowers, zero-turn mowers
- Generators: Portable generators, standby generators
- Outdoor Power Equipment: Chain saws, trimmers, pressure washers, snow blowers
- Engine Diagnostics: Computerized diagnostics, compression testing, fuel system analysis
3. Customer Responsibilities
Customers agree to:
- Provide accurate information about their equipment and the issues they are experiencing
- Transport equipment to and from our facility safely and securely
- Pay for services rendered in accordance with our payment terms
- Follow all safety instructions provided by our technicians
- Remove all fuel from equipment before drop-off, when possible
4. Service Estimates and Pricing
All estimates provided are based on the information available at the time and are subject to change upon further inspection. Final pricing will be confirmed before any work begins. We reserve the right to adjust prices for parts and labor as needed.
- Estimates are valid for 30 days from the date issued
- Additional charges may apply if the scope of work changes
- Diagnostic fees are applied to all estimates and repairs
5. Payment Terms
Payment is due upon completion of services unless other arrangements have been made in advance:
- We accept cash, credit cards, checks, and mobile payments
- A 50% deposit may be required for extensive repairs or parts orders
- Accounts over 30 days past due may be subject to a 1.5% monthly finance charge
- Returned checks will result in a $35 fee plus any bank charges
6. Service Commitment
We stand behind our workmanship and provide quality assurance on our repairs:
- Labor service period: 30 days on all repairs
- Parts service period: As provided by the manufacturer
- Service does not cover damage caused by misuse, improper maintenance, or unauthorized repairs
- Equipment must be returned for service work; we do not provide on-site service
7. Limitation of Liability
Customer acknowledges and agrees that Midwest Turf & Repair shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the use of our services, including but not limited to:
- Loss of use of equipment
- Lost profits or revenue
- Damage to property other than the equipment being serviced
- Any claims by third parties
8. Equipment Storage and Abandonment
Customers are responsible for picking up their equipment within 30 days of completion of services:
- Equipment not picked up within 30 days may be subject to storage fees
- Equipment not claimed within 90 days may be considered abandoned
- Abandoned equipment may be sold or disposed of at our discretion
9. Safety and Indemnification
Customer agrees to indemnify and hold harmless Midwest Turf & Repair from any claims, damages, or expenses arising out of:
- Customer's use of repaired equipment
- Failure to follow safety instructions
- Unauthorized modifications to equipment
- Use of equipment in violation of these terms
10. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Midwest Turf & Repair and is protected by applicable copyright and trademark laws. Customers may not use any of our intellectual property without our written consent.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any such changes constitutes acceptance of the new terms.
12. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions. Any legal action arising out of or relating to these terms shall be brought in the courts of Sedgwick County, Kansas.
